Key Calling, LLC Terms and conditions for PRE PAID Service.

These Terms of Service constitute the agreement between Key Calling, LLC ("we,""us" or "Key Calling, LLC, LLC") and the user("you," "user" or "Customer") of Key Calling, LLC,LLC long distance services and any related products or services("Service"). This Agreement governs all the Service acquired.

BYACTIVATING ORUSING THE SERVICE, YOU REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTERINTO THISAGREEMENT AND THAT YOU HAVE READ AND UNDERSTAND FULLY THE TERMS ANDCONDITIONSOF THIS AGREEMENT.

Key Calling, LLC Prepaid Calling Agreement—Subject to Change at Any Time In the Sole Discretion of Service Provider. By purchasing or using the Key Calling, LLC prepaid calling service ("Service"), the user (or “You") accept/s the rates, terms, and conditions ("Terms")identified on this page as such Terms are updated from time to time and without notice. Email customer service at customerservice@KeyCalling.com. Customers in the U.S. and Canada can call 1-866-423-0918 between 5:00 PM and 10:00 PM ET five days a week, to contact customer service, to report a problem, and to inquire about international rates, charges, access numbers, and country codes. The Terms include the following:

Rates vary and are subject to change;
Key Calling, LLC is not available for calls placed from Alaska;
Calls are billed in increments of one minute, with fractions thereof rounded up to one minute.

No representation or warranty, express or implied, is made regarding available number of minutes to a particular country or remaining number of minutes to a particular country. Any marketing material, rate table, or voice prompts that refer to such information do not account for the charges, fees, rates, assessments, and incremental billing described above.

You should make every effort to safeguard your account number and PIN. Key Calling, LLC is not responsible for lost or stolen PINs or an authorized use.

Credit card fraud is a criminal offense. At Key Calling, LLC, we use automated and manual systems to confirm proper credit card authorization, including having Key Calling, LLC representatives call persons who have signed up for Key Calling, LLC. We also track every transaction. Information related to fraudulent transactions, including but not limited to IP addresses, detailed call records, transaction data and email addresses is collected and provided to appropriate law enforcement officials to assist in the prosecution of any persons attempting to commit fraud on the Key Calling, LLC web site.

Refund/Credit Policy

At Key Calling, LLC we are committed to delivering high quality service every day. However, circumstances beyond our control may result in occasional subscriptions in service. We will issue a credit or a refund in the following circumstances:

If you are charged for a call that was never completed (there was no answer).Upon verification, we will credit your account the amount charged;
If you have an active account with less than $5 USD usage, and wish to discontinue the service;
If you have unintentionally created two or more Key Calling, LLC accounts and want to close the additional accounts, and if you were incorrectly charged for services not received or for which you did not sign up. In such cases, you must contact Key Calling, LLC within 24 hours of the attempted call or discovery of the erroneous charges.

Cancellation Policy

You may cancel your account during the first $3.00 USD of usage and receive a full refund. Following this trial period, you may discontinue service at any time by providing written notice (either electronic or through the postal service) to Key Calling, LLC customer service. We will then shutdown access to your account. Key Calling, LLC is not obligated to refund any of the unused balance in your Key Calling, LLC account as of the date you discontinue service, so we recommend that you use up the remaining balance before terminating the account.

Key Calling, LLC will not be liable for any failure of performance due to causes beyond its control, including, but not limited to, Acts of God, fires, floods or other catastrophes, national emergencies, insurrections, riots or wars, strikes, lockouts, work stoppages or other labor difficulties, preemption of existing services in compliance with any law, order, regulation or other action of any governing authority or agency the reef.

No warranty, express or implied, is made regarding the condition or fitness of the services offered or use of the service for any particular user purpose, including warranties of title or implied warranties of merchantability or non-infringement. Key Calling, LLC does not authorize anyone to make a warranty on its behalf and you may not rely on any statement of warranty’s a warranty by Key Calling, LLC. With respect to any allegation, claim, or dispute related to use of the service provided there under, the liability of Key Calling, LLC, or any of its employees, agents, or cooperating service Providers (the "Parties") shall be limited to an amount equal to the charge for such affected service. IN NO EVENT WILL THE PARTIES BELIABLE FORANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, ORCONSEQUENTIAL DAMAGES. USER ACCEPTS THESE TERMS AND CONDITIONS BY USINGTHESERVICE.

You will indemnify, defend, and hold harmless Key Calling, LL Can its distributors and agents against all claims of loss or damage arising from use of the Service, including (a) allegations or claims for libel, slander, invasion of privacy, or infringement of copyright arising out of the material, data, information, or other content transmitted via the Service, and(b) all other allegations and claims arising out of any intentional actor omission, whether giving rise to criminal or civil liability, by you others authorized by you to use the Service.

Key Calling, LLC may deny or limit use of the Service for any lawful reason. If Key Calling, LLC suspects fraudulent use of the Service, it may be suspended or terminated, and Service calls may be intercepted, without notice.

Key Calling, LLC will not be liable for any act or omission of any company furnishing a portion of the service or of any third party, including those vendors participating in offerings made to You, or for damages associated with service, channels, or equipment that it does not furnish, or for damages that result from the operation of customer-provided systems, equipment, facilities or services that are interconnected with Key Calling, LLC services.

No dispute or claim may be brought as a class action or as private attorney general and you will not have the right to act as a class representative or participate as a member of a class of claimants with respect to any dispute or claim.

Nowaiver of the Terms is valid. Key Calling, LLC, in its sole discretion, may modify and assign these Terms.

The Terms are binding upon You and Key Calling, LLC and upon, respectively, you’re and Key Calling, LLC’s agents and heirs. If any part or provision of these Terms is finally determined to be invalid or unenforceable under applicable law by a court of competent jurisdiction, then that part or provision will be ineffective only to the extent of such invalidity or unenforceability, without in any way affecting the remaining parts or provisions of these Term, which will still be given full force and effect.

Disclaimer of Liability for Damages

INNO EVENT WILL Key Calling, LLC, LLC, ITS OFFICERS,DIRECTORS, EMPLOYEES, AFFILIATES OR AGENTS OR ANY OTHER SERVICEPROVIDER WHOFURNISHES SERVICES TO YOU IN CONNECTION THE SERVICE BE LIABLE FOR ANYDIRECT,INCIDENTAL, INDIRECT,SPECIAL,PUNITIVE, EXEMPLARY, COMPENSATORY, OR CONSEQUENTIAL DAMAGES, OR FOR ANYOTHERDAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, WRONGFUL DEATH,PROPERTYDAMAGE, LOSS OF DATA, LOSS OF REVENUE OR PROFITS, OR DAMAGES ARISINGOUT OF ORIN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE. THELIMITATIONS SETFORTH HEREIN APPLY TO CLAIMS FOUNDED IN BREACH OF CONTRACT, BREACHOF WARRANTY, PRODUCT LIABILITY, TORTAND ANY AND ALL OTHER THEORIES OF LIABILITY AND APPLY WHETHER OR NOT WEWEREINFORMED OF THE LIKELIHOOD OF ANY PARTICULAR TYPE OF DAMAGES.

Entire Agreement

This Agreement, including any future modifications as may occur within the terms of the Agreement, an the rates for Services found on our website constitute the entire agreement between you and Key Calling, LLC, LL Can govern the use of the Service by you, members of your household, guests and employees. This Agreement supersedes any prior agreements between you and Key Calling, LLC, LL Can any and all prior or contemporaneous statements, understandings, writings, commitments, or representations concerning its subject matter.

FUTURECHANGES TO THISAGREEMENT

We may change the terms and conditions of this Agreement from time to time. Notices will be considered given and effective on the date posted on www.keycalling.com. Such changes will become binding on you on the date they are posted to our website and no further notice by us is require upon your continued use of the Service. The Agreement as and when posted supersedes all previously agreed to electronic and written terms of service, including ,with out limitation, any terms included with the packaging of the Device and also supersedes any written terms provided to Retail Customers in connection with retail distribution, including, without limitation, any written terms enclosed within the packaging of the Device.

PRIVACY

Key Calling, LLC,LLC Service utilizes, in whole or in part, the public Internet and third party networks to transmit voice and other communications. Key Calling, LLC, LLC isn’t liable for any lack of privacy which may be experienced with regard to the Service.
